So what do you suggest, have her thrown in the dungeon ?

At least she'd applied for a work visa - just took a
little while for the paperwork to come through.

Trump isn't all that interested in the "working illegals".
They contribute - although they haven't bothered to file
with the system - so they're at the lowest priority on
his shit-list. It's the felonious illegals that are the #1
priority, followed by the do-nothing welfare-leeching
illegals Obama and Hillary were recruiting.

On the whole I agree with the idea of cutting back on
the H1B people. We DO have talent in the USA and
imports are often used not to provide any missing
skills but just as a way to avoid paying US-scale
wages for such talents.

By the way, if there's a shortage of, say, tekkies
even after most such jobs have been filled by our
own citizens then whatever Indian tekkies that
ARE allowed H1Bs can command better wages.
They become "valued" instead of just nobodies
from an unlimited pool of cheap labor.

The B1/B2 visa she came over on allowed her to look for work, not
actually work. But did she pay taxes on the $20k to the IRS? She
would have needed a TIN (like a SSN for non-residents), which the
IRS does issue to undocumented aliens (though you can be sure it
shares those records with Immigration). Did she ever declare that
income after she received her H1-B?

You'll have to take that up with the IRS who have had 20 years to
prosecute her if not.

Her situation was not all that uncommon at the time and back then the
immigration department was a lot more strict than it is now.
But they saw no criminal intent in her actions according to various
articles I've read and because she was in the process of becoming a
full fledged citizen they considered her situation to be minor and not
worth making a big deal over.

At that time Melania had not even met Trump. They were introduced 3
years later in 1998. So she was no different than any other European
immigrant and as stated, was given no real preferential treatment.
The government back then was not too concerned about such minor and
unintentional infractions. They had bigger fish to fry.
